The Dutchman Terms and Conditions
These terms cover browsing this website and making enquiries. Separate contracts apply to Relief Chef support and consulting services.
This website is operated by Hidde Meijers trading as The Dutchman, a New Zealand sole trader. “We”, “us” and “our” refer to that operator. Contact: info@thedutchman.co.nz. Postal address: 11 Mackwell Road, Fairview Heights, 0632, Auckland, New Zealand.
These terms cover use of The Dutchman website at https://thedutchman.co.nz/ and enquiries submitted through it. Relief Chef support and consulting services are governed by separate contracts. These website terms do not set service fees, cancellation rules, employment status, deliverable ownership or other engagement conditions, and do not alter an existing contract.
Chef Harbour is operated by the same individual but has its own website terms and privacy policy for its directory and introduction activities. Those apply to the Chef Harbour sections of this website.
The website provides general information about The Dutchman and its services. General articles, resources, examples and demonstrations are not personalised advice or a guarantee of a particular result. Contact us if you need clarification about information relevant to your enquiry.
Submitting a form, requesting dates or receiving an automated acknowledgement does not confirm a booking, reserve availability, create a paid engagement or commit you to payment. This applies to both new and existing clients. Any service engagement or change to it must be agreed separately under the applicable contract.
We take reasonable care with website information and correct material errors when identified. Website content may change or become outdated. These statements do not excuse misleading representations or override rights available under law.
Provide reasonably accurate information and ensure you have authority to enquire for another person or business. Only submit material you are entitled to share. Do not send passwords, identity documents or unnecessary sensitive, staff or customer information through a general enquiry form.
You retain your rights in material you submit. We use it to handle your enquiry as described in our Website Privacy Policy. Submission alone does not authorise public use of your name, message, images or testimonial, or unrelated marketing. Further information needed to deliver services is handled under the separate engagement arrangements and relevant privacy notices.
Website content, branding and designs belong to us or their respective owners. You may browse the site, share links and keep reasonable copies for personal or internal business reference when considering our services. Do not commercially reproduce or distribute our content, remove ownership notices or imply our endorsement without permission, except where permitted by law.
Content expressly supplied under a separate licence is subject to that licence. Nothing in these terms transfers ownership of third-party material or limits rights that copyright law allows you to exercise
Do not use the website to submit unlawful, deceptive or abusive material, infringe others’ rights, introduce malicious software, attempt unauthorised access, harvest personal information or disrupt normal operation.
We may restrict website access where reasonably necessary for security, legal compliance or to prevent misuse. Any restriction will be proportionate to the circumstances and does not cancel an existing service contract or remove accrued rights.
The website uses external services, including embedded forms, and may link to other websites. External services may have their own terms and privacy notices. A link alone does not imply endorsement. Our Website Privacy Policy explains how we use providers to handle website and enquiry information.
We cannot guarantee continuous website availability or the accuracy of material on websites outside our control. We remain responsible for our own conduct, representations and legal duties. If a form fails or you do not receive an expected response, contact info@thedutchman.co.nz.
Nothing in these terms excludes or restricts any right or remedy that cannot lawfully be excluded, including under the Fair Trading Act 1986, Consumer Guarantees Act 1993 and Privacy Act 2020 where applicable. These website terms do not contract out of those Acts.
We do not guarantee a commercial outcome from using general website information. This does not exclude responsibility for misleading statements or otherwise remove liability imposed by law. Separate service contracts govern the work agreed under them.
We may update these website terms and display the revised effective date. Changes apply prospectively to website use and do not retrospectively change accepted engagements, accrued rights or earlier commitments. We provide further notice or seek agreement where required.
Please contact info@thedutchman.co.nz with website concerns. New Zealand law governs these terms. Nothing prevents access to a competent court, tribunal or regulator, urgent relief or any mandatory protection available under applicable law.
