Chef Harbour Terms of Service

Chef Harbour Terms of Service

1. Operator and scope

1. Operator and scope

Chef Harbour - By The Dutchman is operated by Hidde Hein Meijers as a New Zealand sole trader (“Chef Harbour”, “we”, “our” or “us”). Chef Harbour and The Dutchman are trading names of the same legal person, not separately incorporated businesses. These Terms govern the Chef Harbour website and directory at https://thedutchman.co.nz/chefharbour/home and related Chef Harbour pages, chef and waiting-list enquiries, venue Work Requests and introductions. Contact: info@chefharbour.co.nz.

Where a separate Flagship Chef Participation Agreement is signed or accepted, that agreement governs the specific programme benefits and prevails over these general Terms to the extent of any conflict.

When a form requires acceptance of these Terms, the linked version is made available before submission and acceptance is recorded by an unticked affirmative action. Merely browsing the website is not treated as acceptance of a paid service or a Flagship agreement. Privacy notices explain processing; optional marketing consent and approval to publish a profile are separate decisions.

2. What Chef Harbour does - and does not do

2. What Chef Harbour does - and does not do

Chef Harbour is a directory and manual introduction service. We may publish chef-approved profiles, consider chefs’ stated experience and location when reviewing venue needs, ask questions and pass on general details of potential opportunities. We do not undertake comprehensive background, identity, qualification, licensing or insurance verification of listed chefs.

A Chef Harbour Work Request is not a booking or confirmation that anyone is available. Chef Harbour does not employ or supply chefs under this service, set a chef’s rates, negotiate a chef–venue contract on either party’s behalf, take the chef’s payment or guarantee suitability or work outcomes. Whether any subsequent engagement creates an employment relationship or other legal duties depends on its actual circumstances and applicable law, not merely these Terms.

We do not assign or confirm shifts, manage rosters or attendance, supervise venue work or promise replacement chefs. We have no authority under these Terms to bind a chef or venue to an engagement. We may pass on stated requirements and ask whether a chef wishes to be introduced. Manual selection does not represent a finding that the selected chef is objectively the best candidate

3. Accurate use of the website

3. Accurate use of the website

Users must act lawfully and supply reasonably accurate and up-to-date information in applications, public profiles, waiting-list forms and Work Requests. Anyone submitting personal or business information about others must have authority or another lawful basis to do so. Use of personal information is described in the Chef Harbour Privacy Policy.

4. Independent chef responsibilities

4. Independent chef responsibilities

5. Venue responsibilities

5. Venue responsibilities

Venues must supply genuine Work Requests, explain material role and workplace requirements, and undertake their own appropriate checks before engaging a chef. They must agree payment, working arrangements, induction, food safety and health and safety responsibilities with the chef. Duties imposed by health and safety, employment or other legislation cannot be avoided simply by agreement between users.

Chef Harbour remains responsible for its own applicable health and safety duties. Receiving a credible safety concern may require proportionate protective action. A change to operational services, such as dispatch, recurring roster coordination, attendance or performance management or replacement guarantees, requires a fresh assessment before it is offered.

6. Work Requests and introductions

6. Work Requests and introductions

Work Requests are enquiries only. Chef Harbour may clarify the request and compare it with profiles and stated experience or location. We may first send a potentially relevant chef limited initial information about the work, avoiding identifying details where practicable. If the chef is interested, we may facilitate the exchange of the venue and chef’s appropriate identifying and contact information, in accordance with our Privacy Policy. A chef may decline and we may be unable to identify a match.

After introductions, chefs and venues deal directly with scope, dates, location, rates, GST, invoicing, cancellation, payment, workplace conditions and disputes. Ordinary launch introductions are free and commission-free. If no suitable listed chef is available, we may seek permission to introduce an unlisted chef or offer Hidde’s own services as The Dutchman, expressly disclosing that connection before the venue decides. We may reject unlawful, unsafe, misleading or inappropriate requests.

7. Launch waiting list and future paid services

7. Launch waiting list and future paid services

During Chef Harbour's launch stage, standard chef profiles are available only to invited and approved Flagship Chefs. Ordinary membership is not currently available.

Other interested independent chefs may join the waiting list free of charge to receive relevant updates about future membership opportunities.

Joining the waiting list does not constitute a membership subscription, reserve a profile, guarantee acceptance into the directory, establish priority access or create any payment obligation. No membership launch date, availability, pricing or specific benefit is guaranteed.

Chef Harbour may introduce paid memberships, introductory offers or other promotional benefits in the future. The availability, eligibility, pricing and conditions of any such offers will be determined and communicated when they are introduced.

If paid membership becomes available, prospective members will receive clear information about the services included, applicable fees, GST treatment, billing frequency, renewal arrangements and cancellation conditions before deciding whether to join.

No membership subscription or billing will begin without the applicant's affirmative acceptance of the applicable paid membership terms. Waiting-list participants may decline any offer without charge or obligation.

Future paid memberships may include hosted chef profiles and related services. Their precise features, pricing and conditions will be established before enrolment opens. Any indicative information provided before launch is not a binding offer.

Existing Flagship Chefs retain the free standard profile benefits and rights to individually quoted discounts on optional additional services as provided in their separately accepted Flagship Chef Participation Agreement. The introduction of ordinary paid memberships does not automatically convert their protected free profiles into paid subscriptions.

Ordinary venue Work Requests and introductions are free at launch. Any future changes to fees or commercial arrangements will be clearly communicated before they apply and will not impose retrospective charges on completed introductions.

Additional business tools, website services and other optional offerings may be introduced separately. Their scope, pricing, GST treatment and applicable terms will be disclosed before purchase. No charge arises without separate acceptance.

Standalone websites, hospitality consulting and personally delivered Relief Chef services offered through The Dutchman are subject to their own agreed engagement arrangements and applicable terms.

8. Profile applications and moderation

8. Profile applications and moderation

Profile applications may be accepted, declined or deferred on reasonable directory or capacity grounds. We may ask a chef for clarifications or corrections, but there is no formal chef verification programme at launch. We may correct, temporarily hide or remove content where reasonably necessary for accuracy, unlawful content, safety, misuse or substantial breach of these Terms.

A published listing indicates that the chef approved its public presentation; it is not an accreditation or guarantee of qualifications, identity, work rights, insurance, safety, conduct or availability. Ordinarily we will explain a non-urgent concern and allow a reasonable response; immediate temporary restriction may be appropriate for credible urgent safety or legal concerns.

If we check an NZBN or another register, we describe the actual register, scope and date of the check. A register check is not verification of identity, competence, work rights, insurance or performance. No NZBN is required merely to apply at launch.

9. Chef content and publicity permissions

9. Chef content and publicity permissions

Chefs retain rights in material they are entitled to supply. A recorded approval may cover the approved profile content and its use on the directory, organic Chef Harbour social media and Chef Harbour newsletters to promote that chef. The permission is non-exclusive and limited to those purposes during participation. Paid advertising, unrelated endorsements and material alterations of professional claims or public contact channels require separate approval. Approval to feature a chef in a newsletter does not subscribe that chef to marketing emails.

Chefs must have appropriate rights and permissions for supplied images, text, logos, testimonials and information about others. Routine formatting and cropping must not misrepresent the chef or their work. AI-assisted work is subject to the disclosed privacy arrangements and any additional approval required for the material.

On a pause or withdrawal from the directory, we remove the public profile reasonably promptly. On that event, or a request to stop promotional use, we also remove relevant promotional posts from channels we control reasonably promptly, stop scheduled and future promotion, and remove relevant online newsletter archives we control. Stopping optional promotion alone does not require removal of the directory listing. We cannot recall delivered emails or guarantee removal of independent reposts or search caches. Necessary private evidence may be retained under the Privacy Policy. Urgent protective restriction remains permitted under clause 8.

10. Demonstration & Sample profiles

10. Demonstration & Sample profiles

Sample profiles are conspicuously identified as entirely fictional, AI-generated examples. They do not describe genuine or available chef businesses, do not demonstrate verified expertise and cannot be booked or engaged. Only approved real chefs should be represented as available to receive enquiries.

11. Direct relationships, disputes and payments

11. Direct relationships, disputes and payments

Chefs and venues contract directly. Each is responsible for its independently agreed obligations, including quality of work, attendance, payment, cancellations and disputes. Chef Harbour may assist communication at its discretion but is not required to adjudicate independent contracts.

12. Privacy and reasonable use of contact details

12. Privacy and reasonable use of contact details

Personal information is handled under the Chef Harbour Privacy Policy. Users must not scrape contact details, disclose private information outside the intended introduction or use it for spam, unrelated marketing or harassment. Chef Harbour does not grant a right to add another party to a marketing list merely because contact details were shared.

13. Acceptable use

13. Acceptable use

Do not impersonate others or provide false or misleading professional details or fictitious Work Requests.

Do not harass, discriminate against, threaten or exploit other users.

Do not use the directory for unlawful or unsafe activities, spam, unauthorised scraping or security attacks.

Do not copy substantial amounts of directory content or use Chef Harbour branding without permission.

We may restrict content or access where reasonably necessary and proportionate to a concern.

14. Accuracy, availability and third-party links

14. Accuracy, availability and third-party links

Information about chefs and work opportunities may change. We aim for reasonable accuracy in information we prepare, but cannot guarantee that another person’s claims or availability are correct. We may experience site interruptions or third-party service issues. External websites and providers have their own terms; this section does not remove rights that cannot legally be excluded.

15. Chef Harbour and The Dutchman

15. Chef Harbour and The Dutchman

Chef Harbour and The Dutchman are operated by the same sole trader, Hidde Hein Meijers. The Dutchman separately offers hospitality consulting and personally provided relief-chef services, and may separately offer bespoke digital work. If such a service is proposed in response to a Chef Harbour enquiry, it will be identified as an offer from The Dutchman and will require separate agreement on scope, pricing and terms. Using a different trading name does not create a separate legal liability shield.

The Dutchman’s direct services have separate privacy information and require their own engagement terms. A Chef Harbour enquiry does not authorise unrelated reuse or automatically accept a direct-service offer.

16. Intellectual property

16. Intellectual property

Chef Harbour retains its branding, original website content, platform structure and associated intellectual property. Chefs retain the rights they hold in their submitted professional content. Listing permission is not a transfer of the Framer website, source files or underlying design.

17. Liability and mandatory rights

17. Liability and mandatory rights

To the extent the law permits, Chef Harbour is not a party to, and does not assume contractual responsibility for, the independent chef–venue engagement or for an unrelated party’s breach of that engagement. Each party remains accountable for its own conduct. This does not exclude responsibility imposed by law for Chef Harbour’s own negligence, misleading representations, unlawful processing of information or other conduct.

Nothing in these Terms limits rights or remedies that cannot lawfully be excluded or restricted, including rights under applicable New Zealand consumer protection, fair trading, privacy and other legislation. We do not purport to exclude liability for fraud or wilful misconduct or contract out of consumer guarantees where not legally permitted.

18 Feedback, complaints and changes

18 Feedback, complaints and changes

Please report inaccurate profiles, unsuitable conduct or concerns to info@chefharbour.co.nz. We may investigate and take proportionate action.

We may update these website Terms prospectively with appropriate notice when changes are material. A revision will not retrospectively impose a charge, override accepted Flagship benefits, or substitute for agreement where law requires consent. Continued access after notice does not of itself waive statutory rights.

19. Governing law and contact
